Design - legally protecting aesthetics
Design is a non-technical property right and protects the external appearance of products, graphics and designs. It is not the technical function that is protected, but the aesthetic character of a design – a decisive factor for recognition and market success.
Design protection - requirements and effect
A design is eligible for protection if it is new and has an individual character that distinguishes it from already known designs. The relevant date is the filing date. Under certain conditions, a grace period of twelve months can be claimed.
The application is filed as a formal examination procedure, which usually results in an enforceable property right quickly. Design protection is also comparatively inexpensive and offers high economic relevance.
Term and costs of design protection
Design protection can be maintained for up to 25 years. Renewal fees must be paid after the 5th, 10th, 15th and 20th year. This makes the design right particularly suitable for long-term product and design concepts.
National and international design protection
In addition to German design protection, it is also possible to protect designs internationally. This can be done via national foreign applications or via international systems.
Under the Hague Agreement, protection can be obtained in several contracting states with a single application to the WIPO. It is also possible to apply for a registered Community design with effect for the entire European Union.
